DEFINITIONS In these Booking Conditions: “Booking” means a Booking for a Property. “Booking Conditions” means the terms and conditions of these Booking conditions, including the general notes. “Booking Form” means the Booking form supplied on the Website. “Contract” means the Contract between You and the Owner for the Selected Property as may be amended from time to time in writing between You and Norfolk Coastal Cottages or the Owner. “Data Protection Legislation” means the Data Protection Act 2018. “Norfolk Coastal Cottages” means North Norfolk Coastal Cottages Ltd, a company registered in England and Wales with company number 11819507 whose registered office is 34 Northfield Lane, Wells-next-the-Sea, Norfolk, NR23 1LQ. “Owner” means the Owner of the Selected Property and “we” and “our” relate to the Owner. “Property” means any of the properties advertised on the website. “Rental Fee” means the total fee for the Selected Property as set out on the Website or as otherwise agreed in writing including rental, heating, electricity, use of bed linen/towels, but excluding the Booking administration fee and any charges for additional services provided by Norfolk Coastal Cottages or the Owner. “Rental Period” means the period of time for which You wish to rent the Selected Property as stated in the Booking Form or other written confirmation of the Booking from You. “Selected Property” means the Property specified by You in a Booking. “Website” means Norfolk Coastal Cottages Website at www.norfolkcoastalcottages.com . “You” and “Hirer” means the person who makes a Booking and occupies the Property for the Rental Period.

CONTRACT OF HIRE Norfolk Coastal Cottages acts as Booking Agent on behalf of the Owner of the Property that You will be occupying. The Contract for renting the Property is between the Owner of that Property and You the Hirer. Norfolk Coastal Cottages is responsible for the administration of your Booking and does so solely on behalf of and as agent for the Owner. The contract is only effective once the completed Booking Form and required payment has been received and written confirmation has been sent to the Hirer. The Owner hereby agrees to let the Property to You on the following terms and conditions.

HIRER The Hirer is the person named on the Booking form, and he/she is responsible for the obligations and conditions of hire. The Hirer shall not pass the Booking to another party and shall be in residence at the Property during the whole time of the Rental Period. The Hirer must notify Norfolk Coastal Cottages of any changes to the number of people staying at the Property in writing before the Booking starts, this must not exceed the maximum number allowed to stay at the Property. The Hirer must be aged 21 years or over when the Booking is made.

BOOKING AND CONFIRMATION You may make a Booking by contacting Norfolk Coastal Cottages by telephone on 07710 510516; or sending an email giving details of your Booking requirements to Norfolk Coastal Cottages at info@norfolkcoastalcottages.com; or Booking online at www.norfolkcoastalcottages.com. If, when making your Booking, the start date of your proposed Rental Period is more than 8 weeks away, You must pay a non-refundable deposit to Norfolk Coastal Cottages. This deposit is 25% of the Rental Fee. The balance of the Rental Fee is payable 8 weeks before the start of the Rental Period. The entire Rental Fee is payable at the same time as your Booking if the Booking is made 8 weeks or less before the start of the Rental Period. Norfolk Coastal Cottages reserves the right to cancel your Booking at any time and retain the deposit if the balance is not received by the due date. Norfolk Coastal Cottages will issue a Booking confirmation to You once You have either made a booking by telephone or You have successfully completed our online booking process, and in all cases all money due at the time of Booking has been received and the funds have cleared. You should check the confirmation form carefully and notify Norfolk Coastal Cottages immediately in case of any discrepancy or mistake. Once a Confirmation of Booking has been issued for the Selected Property the Hirer is responsible for the total Rental Fee for the Property shown on the Confirmation of Booking. Payments can be made via bank transfer or cheque or Credit/Debit card. There is no charge for payments made by credit card, debit card, cheque or bank transfer. We do not accept American Express or Business Credit/Debit Cards. Norfolk Coastal Cottages charges an administration booking fee of £15 which is in addition to the Rental Fees shown on the website. Bookings made through the online Booking system are provisional until confirmed by Norfolk Coastal Cottages.

SECURITY/BREAKAGES DEPOSIT A security/breakages deposit is required to be held at the time of final payment (to be paid by cheque or debit/credit card authorisation). The security/breakages deposit for each property is £250, in line with a standard home insurance excess. If you pay using a credit or debit card, you are giving us authority to pre-authorise it for the security deposit. Please note that the security deposit will not be taken from pre-authorised cards, and cheques will not be cashed unless there is a problem found in the property after departure. All or part of the security deposit will be retained if the property is not left in the clean and tidy condition in which it was found, to cover the cost of any additional cleaning and laundry required over the usual designated amount, removal of excess rubbish, any damage to the property content or the replacement of bedlinen or towels, or the homeowner’s insurance excess if a repair or replacement exceeds the specified deposit amount. If the cost of rectification for losses or damage caused by the Hirer or a member of their party exceeds the security deposit held, Norfolk Coastal Cottages will advise the Hirer of any additional amount owning and shall forward the Hirer’s contact details to the Owner for them to facilitate recovery directly. The Owner or Norfolk Coastal Cottages reserves the right to repossess the Property at any time, where the Hirer or any member of the Hirer’s party has caused damage and, in such circumstances, the Owner or Norfolk Coastal Cottages shall not be liable to make a refund of any remaining portion of the accommodation rental paid.

CANCELLATION Any cancellation made by the Hirer for whatever reason should be made in writing or by email to Norfolk Coastal Cottages. Norfolk Coastal Cottages on behalf of the Owner will, upon receipt of the notice of cancellation, look to re-let the Property for the booked period. If Norfolk Coastal Cottages is successful in re-letting the Property, we shall refund a sum equal to the Rental Fee received for the re-letting, less the initial deposit and an administration charge of £20.00. If Norfolk Coastal Cottages is unable to re-let the Property, then the Hirer is deemed liable for the total rental price of the Property shown on the Confirmation of Booking. The Contract of Hire is made on the understanding that the Property and its facilities advertised are available for the dates stated. In the unlikely event that the Property is not available through events arising outside the control of the Owner/Norfolk Coastal Cottages, then the Owner/Norfolk Coastal Cottages may be forced to cancel the Booking and the Hirer will be advised as early as possible. Where possible the Hirer will be offered alternative dates at the same Property at a reduced rate or suitable alternative accommodation, which, if not acceptable, will entitle the Hirer to a refund of all monies paid. The Hirer will not as a result have any further claims against the Owner or Norfolk Coastal Cottages.

ALTERATIONS TO BOOKINGS Rarely, for reasons beyond the control of Norfolk Coastal Cottages, we need to cancel or alter arrangements made for the Hirer; in this event we will contact You as soon as possible to endeavour to find alternative accommodation or offer a full refund of monies paid to date. We will not accept consequential damages and liability is limited to a full refund of monies paid.

PERIOD OF HIRE Rentals commence, unless otherwise stated on the Booking form, at 5pm on day of arrival and terminate at 10am on day of departure. Please do not arrive early, unless previously arranged, as time is needed to clean the Property between lets. Special arrival & departure times agreed with Norfolk Coastal Cottages will be confirmed in an email. Please leave the rental property how You found it, locked and the key returned to the key safe.

COMPLAINTS PROCEDURE In the unlikely event of a problem, all complaints must be received before the end of the holiday rental to enable any issues to be resolved. Please note that no correspondence can be entered into concerning complaints made upon departure or after your return home.

HOLIDAY INSURANCE Norfolk Coastal Cottages recommend the Hirer to arrange holiday insurance to include cover for cancellation and the Hirer’s personal Property.
USE OF PROPERTY The Property will be used for personal and domestic purposes only. The Property shall not be used for any commercial purposes. All children staying at the Property must be accompanied at all times by their parents, or legal carers. The Owner reserves the right to terminate the Hirer’s stay if they or members of their party display unreasonable behaviour or excessive noise, cause nuisance to other parties or damage to the Property, or if the number of persons occupying the Property exceeds the maximum stated. This Booking is granted by the Owner to the Hirer for the Rental Period and is not intended to create the relationship of Landlord and Tenant between the parties. The Hirer is granted the right to occupy the Property for the holiday period specified but the Hirer has no right to remain in the accommodation after this time and shall not be entitled to any statutory security of tenure.

RIGHT OF ENTRY The Owner or representative of Norfolk Coastal Cottages reserves the right to enter the Property at reasonable times to inspect the Property and carry out both emergency repairs and normal maintenance including gardening etc., or at anytime if there is cause for concern that the Booking Conditions are being broken.

PETS Pets, where accepted, must always be kept under control and supervision. They must not be allowed on the furniture or in the bedrooms. Registered assistance dogs may be allowed in properties where the descriptions states dogs are not allowed, but only by separate agreement of the Owner. Please ensure that the gardens are cleaned of their mess before your departure. If you or any member of your party has a pet allergy, we cannot guarantee that dogs, or other pets, have not stayed in your Selected Property, even if the owner does not allow pets, nor can we accept any responsibility for any subsequent health reaction. It is your responsibility to make specific enquiries before Booking as some Property owners may take their own pets to their Property.

SMOKING Smoking is not permitted on any part of the Property.

WIRELESS BROADBAND Where a wireless broadband service is provided it is intended that this service is primarily for email, downloading small files and “surfing” and should only be used for legal uses. Excessive downloading of very large files will be chargeable. Please note that the broadband speed at the Property cannot be guaranteed.

HIRER’S RESPONSIBILITIES The Hirer is responsible for the Property and is expected to take all reasonable care of the furniture, pictures, fittings and other contents and shall leave them in the same state of repair and condition at the end of the rental period as at the beginning. All equipment, utensils etc must be left clean, and the Property must be left clean and tidy at the end of the hire period.

SPECIAL CONDITIONS & RESTRICTIONS Any special conditions for a Property are noted on the Property web page, the Booking Form or accompanying letter.

CIRCUMSTANCES BEYOND THE CONTROL OF THE OWNER / NORFOLK COASTAL COTTAGES Except where otherwise stated in these Booking Conditions, neither the Owner nor the Norfolk Coastal Cottages shall be liable for any change or cancellation which is a result of unusual and unforeseeable circumstances beyond its reasonable control; for example, breakdown of domestic appliances, plumbing, wiring fire, flood, exceptional weather conditions, epidemics and invasion of pests.

DESCRIPTIONS Whilst every effort is made to ensure the accuracy of the Property details, all statements are made in good faith and are for guidance only. Photos, maps and floor plans are for illustrative purposes only.

BED LINEN AND TOWELS Bed Linen and Towels are provided in all our properties. Bedding is not supplied for cots or travel cots. Towels must remain inside the Property and should not be used as beach towels. If you are staying in a Property for two weeks or more, bed linen and towels will be changed and a light clean throughout the Property.

TANNING PRODUCTS Tanning products can stain towels and bed linen and we request that wherever possible products are only applied in a bathroom, are not applied before going to bed and are thoroughly removed from hands after application. A charge may be applied if stains on linens and towels cannot be removed and the items have to be discarded.

REFUSE COLLECTION It is the Hirer’s responsibility to make sure no rubbish is left in the Rental Property at the end of their stay. Black and green bins are collected by the local authority on an alternate fortnightly basis. Norfolk Coastal Cottages and Owners are not responsible for the removal of excess rubbish.

RETURN OF PERSONAL BELONGINGS In the event of any items being left in the property Norfolk Coastal Cottages will attempt to locate, package and post the items back to You, but return cannot be guaranteed. There is an administrative charge of £10 for this, plus the cost of postage.

DATA PROTECTION The Owner and Norfolk Coastal Cottages are joint Data Controllers of all Personal Data provided to Norfolk Coastal Cottages by You. The Owner agrees that Norfolk Coastal Cottages can process such Personal Data on its behalf, for the purposes of processing and administering your Booking. The Owner and Norfolk Coastal Cottages will comply with the Data Protection Legislation and any directions issued by the Information Commissioner in the processing of such Personal Data. To the extent that Norfolk Coastal Cottages is a Processor, You agree that Norfolk Coastal Cottages may Process the relevant Personal Data and may need to pass your Personal Data on to third parties who need to know them so that the Booking can be provided. When acting as a Processor, in relation to the Booking and the Contract, Norfolk Coastal Cottages shall process the Personal Data only to the extent necessary for the purpose of providing the services for the Rental Booking.
